“Kosovo automatically inherited property of Yugoslavia and Serbia” (RTK)

Kosovo’s Ministry of Justice has issued a press release specifying that the decision of the government of Kosovo to register as its own the immovable property originally registered under former Yugoslavia and Serbia is based on the Constitution of Kosovo and declaration of Kosovo’s independence.  “As an independent country and based on international law rules, Republic of Kosovo has automatically inherited ownership over Yugoslavia and Serbia state property as stipulated in the decision of the Republic of Kosovo Government. This is also confirmed in the Comprehensive Proposal for Kosovo Status Settlement (Ahtisaari’s Plan) which is incorporated as an integral part of the Constitution of the Republic of Kosovo,” the press release reads.  As Ahtisaari’s status proposal came into force along with the Constitution of Kosovo, the movable and immovable property of Yugoslavia and Serbia automatically became property of Kosovo, the Ministry of Justice added.  The Ministry said the decision of the government of Kosovo only called for correction to the cadastral data so that they reflect accurately the legal situation created when the Constitution of Kosovo entered into force.
