According to the writer of this editorial peace, Halil Matoshi, the request of Kosovo allies to establish the special court for the alleged war crimes is a confirmation of Kosovo’s sovereignty as a subject of the international justice. If the opposite was the case, considers Matoshi, then, based on Resolution 1244, the United Nations together with Serbia, would establish a court which would have jurisdiction over Kosovo.

Therefore, he continues, establishment of the special court by the Assembly of Kosovo, is a vital state interest. “Secondly, it is a confirmation of being a sovereign state and subject to the international justice and realistic international relations.”

According to Matoshi, establishment of the court is proof that Kosovo is a normal state and not a failed one. “A normal state, ruled by state reason (Raison d’Etat)” he writes adding that the decision to establish the court would also represent a state which supports human rights mechanisms and which has sensitivity for the victims.
