Detention for terrorist suspect continues (Lajmi.net)

Court of Appeals has kept in power the detention measure for the five individuals suspected for criminal offense of “preparing terrorist criminal offences, or offences against the constitutional order and security of the Republic of Kosovo,” Article 144, related to the Article 135 of the penal code of Kosovo. Therefore the panel of judges rejected the appeals of the defendants, B.L., E.L., M.H., G.H., and F.M., as not grounded, and certified the decision of the Basic Court in Pristina, PPKR.NR.254/2015, dated 13.07.2015.

According to the assessment of this court, claims mentioned in the appeals, do not stand and the judge of the Basic Court has justified grounded suspicions that the respective individuals have committed criminal offences suspected by the prosecution.

The court also considers that based on Article 187 of the Code for Criminal Procedures, there are legal reasons to detain the above mentioned suspects, being that if released, they can escape, destroy or hide material evidence, affect the witnesses or repeat crimes offences.
