Hasani: Only the Serbian List can represent the Serbian community in government (Kosovo online)
According to former Kosovo Constitutional Court President Enver Hasani only representatives of the Serbian List can represent the Serb community in Kosovo, in parliament and government.
"The Constitution is clear in terms of our constitutional democracy, meaning that the division of powers is done according to the principles of the Constitution where the majority and minority communities are equal. In this sense, the Constitution says that members of the Serb community are represented in the government and the Assembly by the number of votes cast. In this case, the Serbian List received all the votes of the electorate of the Serb community and only it can represent that community in Kosovo's parliament and government," Hasani told portal Kosovo online.
He states that the Constitution gives two options when it comes to appointing ministers.
"The nomination decision should be formally endorsed by the parties, citizen groups or coalitions that received the largest number of votes, and if persons inside the parliament are nominated, then consultations will take place. In both cases, the will of the representatives of that community, in this case is the Serbian List, is of a constitutive nature, not declarative one."
