Commission for Human Rights discussed the Anti-Discrimination Law (Kontakt plus radio)
Members of the Commission for Human Rights, Gender Equality, Missing Persons and petitions discussed the Anti-Discrimination Law. Given the lack of harmonization of this law with other normative acts, the issue of adopting a new or amending the existing law was raised, reports Kontakt plus radio.
Ombudsman Hilmi Jashari believes that the Law on Protection against Discrimination, adopted in 2015, is not in accordance with other laws, especially with the Gender Equality Act and the Law on the Protector of Citizens.
"This law says that a public attorney can represent citizens in court, and the Law on a Public Attorney says that the protector of citizens is independent and impartial. If I am part of the judicial process in which I directly represent the party, it is normal to raise the question of the independence of the public attorney", says Jashari.
Chairperson of the Commission for Human Rights, Gender Equality, Missing Persons and Petition Duda Balje asked the protector of the citizens whether it is necessary to pass a new law on protection against discrimination, or amendments are enough. Ombudsman advocates amending the law and adds that the ways in which this will be done should be considered.
After the discussion on the Discrimination Act, the commission members asked additional questions to the protector of the citizens Jashari.
"A lot of young people are in prisons and what their legal position is? According to my information they do not have the right to continue their education. What can we do and is it a violation of human rights?" asked Balje.
"According to the world standard, those who are deprived of their liberty are not denied other rights, in this case the right to education. The system has to enable them because they must socialize and be part of society," Jashari replied.
After a member of the commission in front of the Serbian list Sasa Milosavljevic left the session, a translation into the Serbian language also interrupted, reports Kontakt plus radio.
