The number of the properties registered in Kosovo under the name of both spouses, is increasing. This also increased number of women that became owners or inheritors of property.
This increase is evident recently and follows the entry into force of an administrative instruction of 2016, which stimulates the registration of common immovable property on behalf of both spouses in public registers.
According to the data of the Kosovo Cadastral Agency and the Agency for Gender Equality, agencies overseeing the implementation of the administrative instruction state that before the entry into force of this instruction there were 104 properties registered on behalf of spouses. Whereas, after 2016 up to date, the number of properties on behalf of two spouses has reached 2912 cases.
According to officials of the Agency for Gender Equality, this is a special measure aimed at improving the position of women through increasing their access to property.
Based on the administrative instruction, the joint property of spouses means property created during marriage which is registered as a joint property, administered jointly and cannot be alienated without the consent of the spouses.
