Haradinaj cannot be extradited to Albania (RTS, KIM radio)
The fact that Ramush Haradinaj has received citizenship of Albania is not essential to the process in Colmar, said Ministry of Justice to RTS, explaining that Haradinaj cannot be sent to Albania only because he acquired the citizenship of that country, because it is not a basis for seeking his extradition.
The Court of Appeal in Colmar after two delays will announce tomorrow the decision on Serbia's request for the extradition of Ramush Haradinaj.
The proceeding against Haradinaj was initiated in Serbia and Serbia is looking for him, regardless of his nationality, said the Ministry of Justice.
To whom a person should be extradited, is on a country that received request for extradition, in this case France, said the Ministry among other things.
They point out that citizenship is not a basis for seeking extradition.
"Serbia does not have an agreement with Albania, which would allow the accused for war crimes in one country to be tried in the other one, whose citizens they are, but we point out that a decision on possible deviation can be made only by the competent court. But, notwithstanding the absence of a contract, the court is the one which makes the final decision on whether a trial will be ceded to or not," RTS was told by the Ministry.
