Petrov: Time for referendum on Kosovo (KIM radio)

The time has come, maybe, that decision about referendum is mace, where citizens would have their say on whether Kosovo and Metohija should constitutionally still remain part of Serbia, said professor of the constitutional law at the Faculty of Law in Belgrade Vladan Petrov to FoNet agency.

Petrov argues that incumbent political leadership has quite wide democratic legitimacy, thus they are absolutely entitled to assess whether the time has come to ‘cut’ current situation, having in mind the real state of affairs in negotiations between Belgrade and Pristina.

That would mean, according to him, that sensitive decision about the status and further survival of Kosovo and Metohija, as the part of Serbia, would be made on referendum, while later policy would follow the decision of people expressed on referendum.

Petrov highlighted that Brussels agreement is the result of one phase of negotiations, which ‘implies abandoning of the complete sovereignty of Serbia on the territory of Kosovo and Metohija’.

He went on to say that Constitutional Court should declare Brussels agreement unconstitutional, however that would not change the factual situation in Kosovo where Serbia doesn’t have any authority.

Thus, according to Petrov, in case of such decision of the Serbian Constitutional Court government should position itself differently in further negotiations.
