The paper’s political editor, Agron Halitaj, writes that the Constitution of Kosovo has many shortcomings and while it stipulates that the president, assembly speaker and prime minister cannot all travel abroad at the same time, it fails to provide a solution for a situation if the president is unable to carry out her functions when there is no legally elected assembly speaker. The author finds the Constitutional Court responsible for leaving the president without a replacement when it decided to suspend Isa Mustafa’s election as the assembly speaker.
The Constitutional Court has been set up as an institution that would interpret the Constitution of Kosovo but it was not under its competencies to block the works of the Kosovo Assembly. “With its last decision, this court has gone above the Assembly and has risen above the state. It has assumed the right to send on leave elected representatives”, writes Halitaj.
