Isa Mustafa, leader of the Democratic League of Kosovo (LDK), said that the Democratic Party of Kosovo (PDK), and the Constitutional Court should bring arguments to the opinion on how is the government and the Assembly Speaker or the deputies elected in a parliamentary system without a parliamentary majority.
Mustafa mentioned John Tunheim, the U.S. judge and drafter of the Constitution of Kosovo as well as his explanation for the parliamentary system. This is what he wrote in his Facebook profile:
The U.S. Judge, drafter of the Constitution of Kosovo, John Tunheim explained clearly the parliamentary system. He stressed that “Kosovo is a parliamentary system, therefore the government cannot establish without parliamentary majority.”
Therefore, without having the parliamentary majority, you can propose the government and Assembly bodies, however, majority elects them.
We were all aware of this, however it remains now for the PDK and the Constitutional Court to learn, or to bring their arguments to the public opinion on how a government, Assembly speaker and the deputies are elected without the majority in a parliamentary system. If at least the Constitutional Court does not do this, then it definitely proves that it is not an independent institution based on Constitution, but it has taken a political side in this vital process for Kosovo.
