UN Security Council waiting for the Kosovo Assembly (RTK)

If the Kosovo Assembly fails to adopt the special court, which is expected to address war crimes allegations, then the United Nations Security Council will do so. Eri Kaneko, the Associate Spokesperson to the United Nations Secretary-General, told Radio Kosova via email that the UN General Assembly or the Security Council have the mandate to establish the special court and that the process would have to be initiated by Security Council member states. Local media have reported that the Kosovo MPs on May 29 will discuss the constitutional amendments that pave way to the special court; however, it remains unclear, if the Assembly will adopt the special court or if the matter will go to the UN Security Council. Diplomatic representatives in Pristina have said on several occasions that Kosovo’s institutions, in cooperation with the international community, must establish the special court as soon as possible and that otherwise the United Nations will have to set up another Hague Tribunal, specifically for Kosovo.
