Brussels serving us the contract with Kosovo (Vecernje Novosti)

All reached agreements would become part of legislation through ratification.

Legally binding agreement which Belgrade is supposed to sign with Pristina will be verified by the European Union, and then it would reach Serbian parliament for ratification in a form of the ‘agreement between the EU and Serbia that refers to Kosovo’ in order to become part of our legislation.

Novosti learned that such solution is considered in Brussels, and will be offered as a way out from the current insoluble situation.

In the end of the negotiation process with the EU, Belgrade will also be offered to accept a legally binding agreement that will define our relations with Pristina, whereas many fear that it will be interpreted as recognition of Kosovo. Despite the fact that there are several years ahead of that moment, the state leadership conveyed that that they said long time ago that they will not fall in a trap and sign ‘international’ agreement with our province. This is why Brussels is trying to find a model acceptable for all.

President Tomislav Nikolic said several times that legally binding agreement with Pristina is viewed by him as an interstate agreement which he wouldn’t sign even if the parliament would adopt it.

According to the analysts Dusan Janjic, first step will be the change of Constitution, where it wouldn’t even be disputable for the EU if Kosovo remains in the preamble with the formulation which would mention normalization of relations, but without insisting on the definition of the territory:

“In the end of negotiations between Serbia and the EU about the membership, all agreements with Pristina will be verified by the EU and then they will reach our parliament as an agreement between the EU and Serbia with regard to Kosovo. With its ratification, all Brussels agreements would become part of our legal system and it would provide that all signed documents from the Brussels process, which where assessed as anti-constitutional, would receive the legal legitimacy.”

The chairperson of the Serbian parliament’s working group in charge for the European integration, Aleksandar Senic, says that parliament can adopt only international agreements with states, thus it is unrealistic to expect ratification of agreements with Kosovo.

“In theory it is possible that such contracts are made as a part of the reports on negotiations and to be adopted as such, however I don’t know whether the ruling majority is ready to do it,” said Senic.
