The name “Republic of Kosovo” is not stated in the agreement on the energy sector, which was recently signed by the representatives of Belgrade and Pristina in Brussels, but it is written in the so-called “disclaimer”, i.e. statement on disclaimer of liability which is located in the main text of the agreement. The part states views of both sides on the property issues in Kosovo. Property, namely, has been an obstacle in the signing of the agreement, and as Danas learned from a source in the Government of Serbia, that part is listed on the EU’s insistence as the subject of further discussions. Therefore, the issue of property (Gazivode, Valač) does not affect this agreement.
According to the findings of Danas, each of the sides in the “disclaimer” has presented its vision of the property issue and it was agreed to be the subject of further discussions. Pristina has constantly sought to insert the issue of property in the energy talks, which was not foreseen by the first Brussels Agreement, adds our source in the government.
“Kosovo considers that, in accordance with the Constitution and laws of Kosovo and the international law, and UNSCR 1244 and relevant UNMIK Regulations, the property in the territory of Kosovo is owned by the Republic of Kosovo. Serbia considers that, in accordance with the national and the international law, respectively and UNSCR 1244, property in the territory of Kosovo is the property of Serbia, pursuant to a special organisation of the province and is fully in conformity with the Constitution of Serbia,” said the statement about disclaimer of liability with the Agreement on energy published on the website of the Office for Kosovo and Metohija.
Recall, the Kosovo Minister in charge of dialogue with Belgrade Edita Tahiri, said that Serbia has recognized the “Republic of Kosovo” in the Agreement on energy, while the Government’s Office for Kosovo and Metohija said that it was not true and that “whoever loses has a right to be angry, but has no right to fabricate”. The cabinet of the Prime Minister also told Danas that “the Republic of Kosovo” does not stand anywhere. Tahiri also has stated, in a short report on what was recently agreed in Brussels, that Serbia gave up its insistence on the use of footnote in the agreement signed by Prime Minister Aleksandar Vucic; and thereby in some way has recognised Kosovo independence. Tahiri’s report was published on the website of the Government of Kosovo in Albanian and English, but not in Serbian, although reports, usually, are published on three languages.
