Kosovo in danger of Bosnian model (koha online)

A range of legal actions await the new legislation after the endorsement of the EULEX’s mandate and creation of the special court. However, one of them should not be allowed, because it returns Kosovo’s independence to the time of international supervision and transforms Kosovo into the Bosnian model of a state. It concerns the extension of the mandate of the international judges at the Constitutional Court, that of the international members at the Property Agency board as well as at the Office of the General Auditor. This was requested by the President of Kosovo, Atifete Jahjaga and by head of the Constitutional Court, Enver Hasani. Assembly deputy, Arsim Bajrami, told Top Channel that this is in contradiction with the Constitution of Kosovo.

He said that the new legislation should prevent this throwback of Kosovo. “I think that the Assembly should reject these tendencies, that would return international presence at the Court. We can accept EULEX mission, because it was included in Ahtisaari’s agreement, but we cannot renew supervision of foreigners at the Constitutional Court or other agencies, because this would have been a setback which would practically hold Kosovo hostage and transform it into a Bosnian model, where unfortunately, the international community has never had an exit mechanism and it remained there. We should not allow this to happen to Kosovo, because it is a country with complete independence, recognized by 106 countries and we have to believe in this country and invest to take over our responsibilities,” said PDK deputy Arsim Bajrami. “This is an attempt of violation, which will become a violation only if it becomes part of some legal instrument, part of some decision or law. However, currently, it is only an exchange of letters,” said Bajrami. He stressed that this request should have been addressed to the deputies of Kosovo Assembly. “Not only that this did not happen, but deputies were not consulted on the issue either,” he said.

“No comment,” was the response of the Constitutional Court contacted by phone on this issue.

Office of the President came up earlier with a statement that everything was done with the consent of the government of Kosovo.

The Constitutional Court currently has three international judges, whose mandate ends on 10 July. The Constitution of Kosovo does not recognize their mandate or the ones of the internationals at the other agencies after the removal of the international supervision.
