Constitutional Court interpreted Jahjaga’s request, decision on Tuesday

The Constitutional Court solved out the dilemma who shall be the PM designate. It decided that the chance should initially be given to PDK to try and form the government, and in case it does not succeed to do so, than the mandate shall be passed to LDK, namely the opposition bloc, KTV sources said.

A KTV source at the Constitutional Court reported that the decision was divided into two parts. In its first part the Court refers to the President that in line with the Constitution she should mandate PDK Head Hashim Thaçi to form the government. However, the second part of this decision says that in case the political parties in coalition with PDK do not succeed to form the government, the mandate shall be passed to LDK, which came the second in last general elections.

The official letter issued by the Court reads that on Monday, 30 June 2014, the Constitutional Court of the Republic of Kosovo has deliberated and has decided on the case KO103/14, submitted by the President of the Republic of Kosovo concerning the assessment of the compatibility of Article 84, paragraph 14, with Article 95 of the Constitution of the Republic of Kosovo. The Constitutional Court shall publish its decision in coming days, the Constitutional Court’s letter says.

Office of the Kosovo President said that they still were not informed about the decision that Constitutional Court took. In a response to TV21, this Office said that the President will wait for official certification of election results by the CEC. They said that any decision of the President will be in line with the Constitution and Constitutional Court’s decision.

In the meantime, leaders of the four political parties gathered on Monday afternoon at AAK headquarters for a meeting. AAK and Vetëvendosje leaders, Ramush Haradinaj and Albin Kurti, said that progress has been marked in their talks. They said that these four political parties have agreed not to respond to PDK’s request for coalition.

EU rules out its involvement in determining Kosovo PM designate

The European Union’s High Representative for Foreign Affairs and Security Policy Catherine Ashton ruled out any chance that Brussels was involved in determining the new PM designate for Kosovo government.

Commenting on reports of some Kosovo media about existence of an envelope with the international proposal for the future Kosovo Prime Minister, the European Union’s High Representative Spokesperson Maja Kocijancic said that these are speculations to no purpose.

Kocijancic confirmed that the EU Special Representative in Kosovo Samuel Zbogar did not come out with any proposal for a technical government, as it was written in Kosovo media, KTV reported. Furthermore, diplomats in Brussels said that in case that Zbogar would get involved in this matter, they would request his dismissal.

ECAP orders CEC to recount 51 polling stations

The Election Complaints and Appeals Panel (ECAP) has ordered the Central Elections Commission (CEC) to recount 38 polling stations regarding candidates of certain political parties, while all the ballot papers must be recounted in 13 polling stations.

After announcement of final election results, ECAP received 61 complaints from the political entities and their candidates.

ECAP chairperson Shukri Sylejmani said that out these complaints, 24 were found as grounded, 36 were refused as ungrounded, while one complaint was filed after the 24-hour set deadline.

Eighteen persons arrested in relation to Mitrovicë/Mitrovica protest

Kosovo Police reported that the 18 persons arrested during last week’s protest in vicinity to Ibër River Bridge are suspected of hooliganism, of putting international staff at risk, assault on official persons, theft and illegal possession of weapons.

The Police reported that the arrested persons mainly come from Mitrovicë/Mitrovica area, expect two of them that come from the municipality of Vushtrri/Vucitrn.

Exhumations at Rudnica mass grave continue

Exhumations have resumed in another location suspected to be a mass grave in Rudnica of Raska. The Serbian High Court gave its permission to resume work.

Director of Kosovo forensics department Arsim Gërxhaliu said that work has resumed in the second location of Rudnica; however, he emphasised that only the earthwork has started.

He said that site examination might last between 20 and 30 days. During the first 64 days, around 50 bodies were found in the first location of Rudnica mass grave.
