The appeal of the Serbian List rejected (KiM radio)

A member of the Central Election Commission, Nenad Rikalo said that the appeal of the Serbian List, related to the distribution of mandates is not considered, because the Supreme Court and the Panel of Appeals noted that it is not within their job description. 

Rikalo said that at the extraordinary session of the Central Election Commission were certified results of early parliamentary elections, held on 8 June. According to the results, the number and distribution of seats in the Kosovo Assembly was unchanged, compared to the results published before the appeal. 

“It is interesting that neither Panel of Appeals, nor Supreme Court considered the subject, i.e. the essence of the appeal. They delayed submitted appeal, on procedural grounds. Court and the Panel stated that they have no mandate to discuss distribution of seats in the Assembly, and it’s not within their job description, “said Rikalo. 

According to him, it left space for the suspicion that the Serbian List is “quite right” about the complaint, but that the institutions “had no courage” to decide about the appeal. 

He pointed out that the next instance is Constitutional Court of Kosovo, which can assess the constitutionality of the decisions, but that as first the Election Law and the Constitution should be aligned.
