The Constitutional Court has not left space for the other parties to elect the Speaker of the Parliament. According to the Court, this post belongs only to the winning party of the elections. However, it appears that the only hope of the Coalition Block LDK-AAK-NISMA, remains on Article 117 of the decision of the Constitutional Court.
“An additional argument is that a parliamentary group, in the strictest sense of the word (in stricto Sensu) and according to the Rules of Procedure of the Assembly and its Annexes, can only be registered after the constitution of the Assembly, i.e. after the election of the President and Deputy Presidents of the Assembly,” is written in Article 117 of the decision of the Constitutional Court
In other words, this means that if PDK elects one of its people for the post of the Assembly Speaker, then LDK-AAK-NISMA coalition block, with the two thirds of the power of the Assembly, can dismiss the Speaker and nominate their candidate, because Article 117 recognizes this right. So the right of the biggest parliamentary group.
