A special court to deal with usurped property in Kosovo (TV Most)

Representatives of Serbs in Kosovo institution announced that they will seek the formation of a special court or a special court unit that would exclusively deal with the issue of usurped property in Kosovo.

Minister of Communities and Returns in the Kosovo Government Dalibor Jevtic told Tanjug that the support for such an idea he would try to obtain at the inter-ministerial group for the return of the displaced, but also from the Minister of Justice Hajredin Kuci and other representatives of the authorities in Pristina.

Jevtic said that, according to available data, 19,000 applications were filed before the courts in Kosovo because of occupied property and that the Ministry of Returns and Communities in cooperation with the OSCE in Kosovo analyses this problem.

The analysis, as announced, will be presented at the meeting of the inter-ministerial group for the return and delivered to the Kosovo Ministry of Justice.

“There are many cases that even after the filing of the application due to usurped property, the process did not start on solving these problems, which is especially troubling,” said Jevtic and recalled that in Kosovo there are court decisions which are “unexpected at least .”

As an example of such decisions he presented the verdict of the Court in Prizren in regards to a family in Prizren. The court brought the decision on return of the property, but the court also ruled that the house has to be demolished, which was meantime built on their property, and the costs paid by the Serbian family, which was absurd he said.

Analyst Petar Miletic told Tanjug that it would be good if the Serbs in Kosovo’s institutions manage to realize the idea of forming a special court or court unit that would deal with the issue of usurped Serbian property but that he was not sure how realistic was this proposal. Because, as he said, there is the Special Chamber of the  Supreme Court of Kosovo dealing with the issue of property not only of Serbs, but of all citizens in Kosovo
