Draft statute for Association/Community to be finalized on August 4 (RTK)

The draft statute for the Association/Community of Serb-majority municipality is expected to be finalized on August 4, the news website reports. Vinka Radosavljevic, head of the management team working on the draft statute, told RTK, “the draft statute for forming the Association will be ready on August 4 as required by Brussels. It will be presented at the councils of both parties and at the high-level dialogue, and then the final text of the statute will be harmonized”. Asked if the draft considers the ruling of the Constitutional Court and Kosovo’s laws, Radosavljevic said, “in our work we don’t deal with politics. The management team relies on what has been achieved in Brussels and this includes the documents that were signed by both parties. The management team must not question the validity of these documents; it needs to act based on these documents and that’s what we are doing”. On the other hand, Avni Arifi, head of the Kosovo delegation in talks with Serbia, said Brussels supports the formation of the Association/Community based on Kosovo’s laws: “Brussels’ position in front of all member states is that the Association must be in line with the Constitution and Kosovo’s laws. The EU representative in Brussels has also made it clear that the Association must not have executive competencies”. Arifi also said that if the draft statute ignores the ruling of the Constitutional Court, it would be sent back to the Court. “If the appointed experts draft a statute that does not take into account the recommendations of the Constitutional Court, then they are walking into a dead-end, because we have an agreement in Brussels which has been questioned by the Constitutional Court and these challenges must be overcome and not ignored, before we can proceed with forming the Association,” he said. Arifi criticized the previous government for allowing the management team to consist of four Serbs. Arifi also said Brussels must be more determined in the process. “I have called on Brussels to be more determined in the implementation of the remaining agreements. We have called on the international community to take on a more active role, we have also asked the U.S. to be involved in the matter. As you know, peace in Kosovo was made when the Americans intervened together with the Europeans. We believe that greater determination and focus by the international community would help resolve the issue,” he said.
