Tribunal outside Kosovo, also proof of EULEX’s failure (Koha Ditore)

Brussels-based correspondent Augustin Palokaj writes that EU diplomats are saying that if Kosovo does not accept the compromises on the EULEX mandate and the war crimes court, it can forget about the SAA and visa liberalization. On the other hand, even if Kosovo makes compromises, and it is already doing so, there is no guarantee that it could be rewarded in the SAA or in the visa liberalization process. Palokaj argues that the request for a court outside Kosovo’s territory, even though it would operate according to Kosovo laws, is an obvious stain for Kosovo. “This makes Kosovo the only country in the territory of former Yugoslavia where war crimes trials would be held outside its territory. This creates the impression that Kosovo is the only state incapable of conducting such trials, that it lacks readiness for this and that it cannot provide sufficient security to protected witnesses. This persistence should also be seen as proof of EULEX’s failure, as the EU mission was tasked with assisting Kosovo authorities to build a judicial system where no one would be above the law, where judges and prosecutors would independently do their job and where witnesses would not have to fear for their lives if they were to testify.
