“Pristina cannot avoid war crimes court” (Vesti)

Lawyer Toma Fila told the Srna agency that Pristina will not be able to avoid the formation of a special court for crimes of the Kosovo Liberation Army (KLA), because America stood behind it to wash away any evidence.

Fila says that they cannot provide security to witnesses, which is the main reason why trials cannot be in Pristina. “One of the biggest flaws of the ICTY is the fact that no one has responded to more than 3,000 victims of the KLA in Kosovo during the war,” said Fila, and recalled that the Hague prosecution in the trial against a KLA commander Ramush Haradinaj failed to protect the lives of witnesses.

Fila, who is a long-time Serbs defence attorney before the court in The Hague, said that every witness who has been recommended in the case against Haradinaj was shot or intimidated. “Which is why they are opting for trials not to be held in Pristina, as they cannot ensure that witnesses will survive the trial,” said Fila, recalling that the court should be moved from Kosovo.

Another reason, says Fila, regarding why Dick Marty’s report on organ trafficking cannot end without justice being served is because the already is formed committee is headed by US prosecutor Clint Williamson.
