Jahjaga with a ‘recipe’ on announcing elections (Gazeta Blic)

President of Kosovo, Atifete Jahjaga, has already a ready-made recipe on how to announce new elections. International experts are said to have prepared the legal roadmap on how Jahjaga could announce elections if the political crisis persists. In a document which Gazeta Blic claims to possess, international experts advise Jahjaga to take into account that article 82 of the Constitution, which refers to the disbanding of the Assembly, is inapplicable as the Assembly has not yet been constituted. “The Republic of Kosovo Constitution has not clearly defined the situation qualified as ‘failure to constitute’ – when elected MPs fail to constitute the Assembly – and this reflects the situation in which Kosovo Assembly is at present”, the document reads.  The experts also highlighted that the only authority who can announce elections is the President of Kosovo and that the best way to proceed is by taking into account the objectives of the Constitution’s authors. In this situation, the only legal possibility to announce new elections is to refer to article 84.2 of the Constitution which states that the President of the Republic guarantees the functioning of the constitution and institutions by arguing that the current situation threatens the functioning of these two.
