The Government of Serbia adopted yesterday report on the agreement on the judiciary, which Belgrade and Pristina initialled in Brussels earlier this week. The Government of Serbia unofficially announces that the Serbian officials would talk with employees in the Serbian judiciary in northern Kosovo on the implementation of the agreement, which provides their integration into Kosovo’s judicial and legal system.
Apparently, as explained to Danas, for the Serbs in the agreed judicial system in northern Kosovo, that includes seven municipalities, will apply special, status-neutral framework. They will not take the oath as their Albanian colleagues.
The President of Kosovo, Atifete Jahjaga, will sign decrees on their appointment based on the list of judges and prosecutors, which Belgrade will submit. Kosovo laws shall apply, and envisaged is the possibility that in Kosovo’s judiciary in north will work and judges and prosecutors from the rest of Serbia, which should solve the concern of the President and Prime Minister of Serbia that Serbs will not have enough qualified staff for the implementation of the Brussels final arrangements.
The judgments, as it was unofficially announced, should have “double documents” – with and without seals and headers of the self-proclaimed state of Kosovo. The Kosovo’s Judicial and Prosecutorial Councils shall dismiss judges and prosecutors, in which need to enter and the Serbian representatives.
Department of the Appellate Court in northern Mitrovica will be the final instance for all Serbian cases in the entire Kosovo, as well as for the entire region.
The Supreme Court, which in some cases will be the final instance for the Serbs, will also enter Serbian judges, according to the Government of Serbia.
Serbian Prime Minister Aleksandar Vucic said yesterday that Belgrade’s negotiating team in terms of justice did “the best it could for the Serbian people.” Vucic announced that Belgrade will in the future continue to behave responsible as until now. He expects, after the resumption of dialogue with Pristina, acceleration of European integration of Serbia, because “everything else would be a surprise and disappointment”.
