Ombudsperson Kurteshi accuses Constitutional Court

When the Constitutional Court declared unacceptable the request of Ombudsperson’s Institution for abolition of President Jahjaga’s decree for extension of the mandate of three international judges, the Court deceived everyone.

These are the doubts of Ombudsperson Sami Kurteshi. According to Kurteshi, based on the written testimony that the international judge Robert Carolan gave, the Constitutional Court falsified the verdict.

In a letter that Constitutional Court judge Robert Carolan had sent to the Ombudsperson Institution, he claims that he was not part of this verdict. However, Kurteshi underlines that the name of this judge is also listed in the verdict. According to Kurteshi, this is an illegal action of the Constitutional Court President Enver Hasani.

“If judge Carolan was not present, the Constitutional Court did not have the necessary quorum to bring a decision on this case, therefore, the ruling of the Constitutional Court to reject the case submitted by the Ombudsperson is legally invalid,” Kurteshi said.

For this matter, Kurteshi has filed another request to Constitutional Court to abolish the decision for extension of mandate of international judges. He also called for resignation of Court’s President, Enver Hasani.

KTV tried to get a reply from the Constitutional Court for the accusations addressed by Ombudsperson; however, its officials did not say anything concrete expect that they have received a new request from the Ombudsperson. 

Assembly elects new Judicial Council members

Kosovo Assembly MPs elected on Thursday three new members of the Kosovo Judicial Council, a decision which breaks this institution’s deadlock, which had no quorum for some months.

Armend Berisha from Pejë/Pec Basic Court, Xhymshyt Galushi from Pejë/Pec Basic Court, and Nehat Idrizi from Prishtinë/Pristina Basic Court were elected as the KJC members with a five-year mandate.

In another voting at the Assembly of Kosovo, Rexhep Gashi was elected as member of the Kosovo Judicial Institute Steering Committee with a two-year mandate.

Aleksandër Lumezi’s decreeing as Chief State Prosecutor will delay for some more time. This came after the Constitutional Court has requested additional information from the Prosecutorial Council for this matter. The same request for additional information has also been addressed to President Atifete Jahjaga, who should decree Lumezi.

Prosecutor Sevdije Morina considers this as interference in Council’s work, underlining that the order given by the Constitutional Court’s verdict has been met.

Prosecutor Morina added that they have no obligations toward the Constitutional Court, as Aleksandër Lumezi’s selection was done through a completely new process.

Lacking the necessary quorum, everything that the Council could do in its extraordinary meeting held on Thursday was to create an authorized group of four members to work on the answer for the Constitutional Court.

Minister Tahiri asks EU officials to dissolve Civil Protection

Through a press release issued, the Office of Kosovo Prime Minister announced that Kosovo minister for dialogue Edita Tahiri has asked the EU officials in Brussels to speed up the process for dissolving Civil Protection, to remove the barricade on the Ibër Bridge in Mitrovica/Mitrovicë north, same as dissolving of all the parallel municipal structures.

Minister Tahiri also asked the EU officials not to allow Serbia to delay implementation of Brussels agreements.

Interpol issues 17 arrest warrants for crimes committed in Kosovo

Interpol’s arrest warrant for the retired Serb General Momir Stojanovic was issued upon initiation of Gjakovë/Djakovica Basic Court. He is accused of war crimes in Rekë e Keqe of Gjakovë/Djakovica, which allegedly were committed against civilian population in April 1999.

Besides the Serb General, Gjakovë/Djakovica Basic Court also accuses 15 other Serbs and one Albanian for crimes committed against civilians.

On Wednesday, Interpol issued 17 red notices, an instrument similar to arrest warrant, for the same number of former Yugoslav Army members, police forces and Serb fighters in Kosovo conflict at the end of 90s.

Commenting the Gjakovë/Djakovica Basic Court arrest warrant issued through Interpol for the Serb General, the Serbian minister Aleksandar Vulin said that Serbia does not recognize any Court in Kosovo which issues arrest warrant for war crimes, KTV reported.
