Analysts: Consequences for Kosovo, in case it does not form a Special court (Blic)

Political analysts in Kosovo assessed that Pristina will suffer enormous consequences in case the amendments to the Constitution and the Law on the Special Court for war crimes will not be adopted.

Analyst Imer Mushkolaj estimated that in such a case, Kosovo would acknowledge that it is not interested to shed light on the allegations from the report of the Council of Europe on the alleged crimes of some former senior officers of the KLA, against Serbian civilians during the Kosovo war. According to him, the issue of the formation of the Special Court in that case would end up in the UN, where there are countries that oppose Kosovo independence, “which would restore the influence of the United Nations in Kosovo.” “In case the UN Security Council Resolution 1244 would be reactivated, the consequences would be huge,” said Mushkolaj.

Analyst Artan Muhaxhiri estimated that the Special Court has no alternative and that Kosovo has shown that it has a weak judicial system, what caused that the international community condition the authorities in Pristina with the establishment of the Special Court on war crimes. “Lack to establish the Court would mean an admission of guilt for those serious allegations against former members of the KLA and some other senior figures who participated in the war. It would also worsen relations with major partners, which would cause huge problems in the way of European integrations of Kosovo” said Muhaxhiri.

In addition to the Kosovo opposition, some MPs are against the establishment of the Special Court while the strongest resistance expressed representatives of organizations created from the Kosovo Liberation Army.

One of them, Xhavit Jashari called on MPs not to vote for the establishment of the Special Court. “We strongly oppose the establishment of the Special Court, which is harmful not only to our values ​​and our struggle, but it is harmful to our institutions, because it overwhelms autonomy, statehood, justice in Kosovo,” he said.
