Opposition with dilemma on whether to send Thaci’s election to the Constitutional Court (Gazeta Blic)

The three opposition parties, Vetevendosje movement, the Alliance for the Future of Kosovo (AAK), and the Initiative for Kosovo (NISMA), have not decided yet on whether to send the case of Hashim Thaci’s election for president to the Constitutional Court. A senior official from the opposition, who preferred to remain anonymous, said that they are assessing all the documentation.

Thaci’s election is invalid because it breaches the rules established by the constitutional court in its judgment annulling the election of Pacolli, in 2011. That decision was wrong, and often absurd (see this essay). But according to article 116.1 of Kosovo’s constitution ‘Decisions of the Constitutional Court are binding on the judiciary and all persons and institutions of the Republic of Kosovo’: right or wrong, the court’s decisions must be obeyed.

Vetevendosje MP Ilir Deda said that Hashim Thaci’s election to the post of Kosovo president has only deepened the current political crisis in Kosovo. He said Thaci’s election will be brought before the Constitutional Court. “Let’s wait and see how this case goes and what political consequences it will produce. Nevertheless, it is clear that the most non-unifying and divisive man in Kosovo politics is at the head of the state,” said Deda.
